Mr. D.S. Mehta, Advocate, for the petitioner. On a reference to the dispute under Section 4-K of the Industrial Disputes Act, an Adjudication Case No. 12 of 2020, M/s Parle Biscuits Pvt. Ltd Vs. Parle Shramik Sangh, Sitarganj, Udham Singh Nagar, was instituted before the Labour Court, Haldwani, District Nainital.

Ever since the registration of the said Adjudication Case No. 12 of 2020, M/s Parle Biscuits Pvt. Ltd Vs. Parle Shramik Sangh, Sitarganj, Udham Singh Nagar, despite of the fact that the written statement has already been submitted by the petitioner, the same is still pending and has not been expedited, rather a consistent adjournment has been sought by the employer.

Hence, this Writ Petition has been preferred for seeking an appropriate direction to the Presiding Officer, Industrial Tribunal/Labour Court Haldwani, Uttarakhand, to decide the aforesaid Adjudication Case No. 12 of 2020, M/s Parle Biscuits Pvt. Ltd Vs. Parle Shramik Sangh, Sitarganj, Udham Singh Nagar, as expeditiously as possible within the specified time frame.

Considering the grounds taken that since the written statement had already been filed and the interest of the employees of the Organisation of the Parle Biscuits Pvt. Ltd., which is the subject matter of consideration before the Labour Court, this Writ Petition is being disposed of with the request to the Presiding Officer, Industrial Tribunal / Labour Court, Haldwani, to make all efforts to decide the proceedings of the Adjudication Case No. 12 of 2020, M/s Parle Biscuits Pvt. Ltd Vs. Parle Shramik Sangh, Sitarganj, Udham Singh Nagar, as expeditiously as possible, but not later than nine months from the date of production of a certified copy of this judgment.

Subject to the above observations, the Writ Petition stands disposed of.
