In compliance of the order passed by the Coordinate Bench of this Court on 15.07.2019 respondents have been served dasti.
The petitioner has taken steps and has filed an affidavit of service through I.A. No.10812 of 2019, where the respondents are shown to have been satisfactorily served.
In view of the aforesaid averments made in the affidavit, the respondents would be deemed to have been served with the notices.
The challenge in the writ petition, as given by the defendant/petitioner is to the concurrent rejection of his application under Order 9 Rule 13 of the C.P.C. which the petitioner has preferred praying to set aside the ex-parte judgment and decree dated 05.09.2016 as it was rendered in Suit No.62 of 2014, Smt. Vishambhari Devi vs. Sanjay Kumar.
Admit the writ petition.
Issue notice to the respondent. The petitioner would take steps for effecting service on the respondent within one week thereafter.
