This is defendant's revision under Section 25 of the Provincial Small Cause Courts Act, whereby the suit of the plaintiff/ respondent No. 1, under Section 15 of the Act, has been decreed by the impugned order dated 22.07.2022, as rendered by the Court of 2nd Additional District Judge/J.S.C.C. in JSCC Suit No. 67 of 2016, Rajesh Kumar Kaura Vs. Om Pal Singh and another.

Since being a regular Civil Revision under Section 25 of the Act, admit the revision. No notices are required to be sent to respondent No. 1, as he is represented by Mr. Siddhartha Sah, Advocate.

Let notice be issued to respondent No. 2.

Steps to be taken by the revisionist within a period of one week from today.

List this matter after the notice is served upon respondent No. 2.

Till next date of listing, the effect and operation of the impugned judgment and order dated 22.07.2022, would be kept in abeyance, subject to the condition, the revisionist furnishes the bank guarantee before the Registry of this Court, within a period of six weeks from today, in relation to the decreetal amount, as decreed by the judgment dated 22.07.2022.

Stay Application No. IA/1/2022 stands disposed of accordingly.
