The proposed appeal has been filed by the State, along with an application for condonation of delay and application under Section 378(3) of the Code of Criminal Procedure, 1973, against the judgment dated 27.10.2021, passed by the District and Sessions Judge, Pauri Garhwal in Special Sessions Trial No.32 of 2019, "State vs. Anup Negi", whereby the respondent-accused has been acquitted from the offence under Sections 354, 324, 506 of IPC and Section 7/8 of the Protection of Children from Sexual Offences Act, 2012.

Heard Mr. T.C. Agarwal, the learned Deputy Advocate General for the State/applicant.

The learned counsel for the applicant/State submitted that the prosecutrix, aged about 16 years, has supported the case of the prosecution.

Issue notice to the respondent on the delay condonation application.

Steps to be taken within a week. List this case on 18.10.2022.
