Issue notice.

Mr. J.C. Pande, learned Standing Counsel for the State, accepts notice for respondent no.1, whereas, Mr. N.S. Pundir, learned counsel, accepts notice for respondent no.2.

The petitioner has preferred the present petition to issue a writ, order, or direction in the nature of mandamus commanding and directing the respondent No.2 to review/ revise the list of selected candidates for the Main examination for the post of Horticulture Development Officer in Uttarakhand Combined State Civil/Upper Subordinate Services Examination 2021 (Annexure No.6 this writ petition), and to include the name of the petitioner in the list of successful candidates qualified for the posts for Main examination, considering the qualification of the petitioner for the post of Horticulture Development Officer (Uddyan Evam Khadya Prasanskaran Vibhag).

The petitioner has qualified B.Sc. in Agriculture (Hons.). She claims that she is fully eligible to participate in the Mains

examination for the post of Horticulture Development Officer in Uttarakhand Combined State Civil/Upper Subordinate Services Examination 2021.

The petitioner cleared the Preliminary Examination and has secured 59.3781 marks in paper one. The cut-off marks fixed by the respondent for the un-reserved category is 18.2319 marks, and the cut-off marks for un- reserved Women is 20.5749 marks.

The learned counsel for the respondent does not dispute the fact that the present case is squarely covered by the judgment dated 02.08.2022 passed by this Court in Writ Petition (S/B) No.434 of 2022 (Kulvindra v. State of Uttarakhand and another).

Accordingly, following the said decision, we allow the present writ petition.

Pending application, if any, stands disposed of.
