Issue notice.
Mr. S.S. Chaudhary, learned Brief Holder for
the State of Uttarakhand / respondent Nos. 1 and
2, appears and accepts notice.
Let notice be issued to respondent Nos. 3 and
4, returnable by 14.11.2022.
The grievance, raised by the petitioner, is that
respondent No. 4 is carving-out a Colony in Khasra
Nos. 87 and 88Ka in Revenue Village Alakhdevi,
Tehsil Gadarpur, District Udham Singh Nagar,
without obtaining the requisite permission. He
submits that the land is agricultural, and the
carving-out of the Colony would lead to
unauthorised construction in violation of the
relevant laws. He places reliance on the judgment of this Court, passed in Writ Petition (PIL) No. 119
of 2013, 'Anuj Kansal vs. State of Uttarakhand and
others' dated 19.06.2018.
We direct the respondent-authorities to ensure
that no illegal carving out of plots is undertaken by
respondent No. 4 without first obtaining the
requisite permission under the law, till the next
date.
