On behalf of the petitioners, a statement has been given that the matter is squarely covered by the judgment of this Court.

Learned State counsel, under instructions, would today submit that though, the case of petitioner no.1 is squarely covered by the judgment of this Court, but according to him, as per instructions, which he has received from the Chief Education Officer, District Udham Singh Nagar, the case of petitioner no.2 is not squarely covered.

The Court wanted to know from the learned State counsel, as to how the case of petitioner no.2 is not covered? He would submit as per instruction received by him, it is not covered.

Be it as it may. The Court leaves it as it is.

State may file its objections. Counter affidavit may be filed within a week.

List this matter for final hearing on 21.09.2021, just after fresh.
