Petitioner impugned a Government Order dated 21.01.2020, by which certain directions were given in connection with Uttarakhand Government Department Subordinate Accounts Cadre (Non-Gazette) Service Rules, 2019. Petitioner has also sought other related reliefs.
It is the case of the petitioner that having successful in litigation with regard to the grade-pay to which they are entitled too, by virtue of the interim order dated 21.01.2020, they have been put in a disadvantage position in so far as their grade- pay after promotion is concerned.
Learned counsel for the petitioner has drawn attention of the Court to the Clause 5 of the impugned Government Order to argue that, in fact, in so far as the prospective effect of the Government Order is concerned, the petitioner has no problem, but if it is made applicable to those who get promotions, it may deny the fruits of the judgment, which was passed in their favour, accepting the claim of petitioner for enhanced grade-pay.
