Mr. Dharmendra Barthwal, learned counsel for the appellant.

Mr. Syed Nadim, learned counsel for the respondents.

Learned counsel for the parties are unanimous on the point that Hon'ble Supreme Court has permitted both the parties to file additional evidence.

Mr. Dharmendra Barthwal, learned counsel appearing for the appellant submits that he has already moved an application under Section 41 Rule 27 of C.P.C.

Having regard to the judgment rendered by Hon'ble Supreme Court, the miscellaneous application (IA No. 12657 of 2021) is allowed. The additional evidence filed along with said application is accepted on record.

Mr. Sayed Nadim, learned counsel for the respondents submits that he also proposes to file an application under Order 41 Rule 27 of C.P.C. On his request, the case is adjourned for four weeks.
