                             JUDGMENT

According to the petitioner, he was allotted a piece of land under the Government Grants Act in Village Kanakpur, Tehsil Kaladhungi, District Nainital, in the year 1976. According to the petitioner, he is in cultivatory possession over the said piece of land. The grievance of the petitioner is that his claim for regularization of the said land in his favour is not being considered by the District Magistrate.

2. Learned counsel for the petitioner relied upon a Government Order dated 02.11.2020 which provides for regularization of category IV land (oxZ4) in favour of the occupants.

3. Since the petitioner's application for regularization of his land is pending since

25.04.2018, therefore, the writ petition is disposed of with the direction to the District Magistrate, Nainital to consider and decide petitioner's application, in accordance with law, as early as possible, preferably within a period of ten weeks from the date of production of a certified copy of this order. While taking the decision, the District Magistrate, Nainital shall also hear all the stake holders qua the land in question.
