CRLR No.49 of 2021
Hon'ble R.C. Khulbe, J.
Mr. DCS Rawat, learned counsel for the revisionist.
Mrs. Pushpa Bhatt, learned DAG for the State.
This revision is preferred challenging the judgment and order dated 25.2.2021 passed by the Sessions Judge, Pithoragarh in Crl. Appeal No.01 of 2017, and judgment and order dated 21.12.2016 passed by the J.M., Pithoragarh in Crl. Case No.438 of 2016.
Admit.
Summon the LCR.
List thereafter.
Also heard on the bail application (IA 1/21). The revisionist has been sentenced to undergo three years' R.I. u/s 498-A IPC with fine of Rs.1,000/- and further, to undergo one year's S.I. with fine of Rs.500/-.
It is argued that the revisionist was on bail during trial and appeal and he never misused the said liberty.
The State counsel has no serious objection to the same.
Looking to the facts and circumstances of the case, the revisionist is enlarged on bail on his executing a personal bond and furnishing two sureties, each of the like amount, to the satisfaction of the Court concerned.
The revisionist, however, shall deposit the fine as imposed by the Trial Court against him.
Bail application is allowed accordingly.
