The Registry of the High Court has reported two defects. The first defect is pertaining to the deficiency of Court fee and the second is proof of service on the respondents.
When the matter was taken up on the previous date i.e. on 28.06.2021, the learned counsel for the petitioners was directed to supply the Court fee. Today, Mr. Bhupesh Kandpal, the learned counsel for the petitioners has submitted that he has already complied the said direction and the requisite Court fee, which was pointed out to be deficient, has already been supplied by him by putting the same in the drop box of the Registry. Hence, in view of the aforesaid statement, the defect as pointed out by the Registry stands removed.
The petitioners, who are 10 in numbers, in support of their contentions for the grant of reliefs, as prayed for in the present writ petition, praying for that their claim for regularisation would be considered because of the fact that they have been rendering their services as Junior Engineer since 2013-14 on contractual basis, though they were appointed after the issuance of an advertisement on 07.06.2014.
The learned counsel for the petitioners has submitted that the issue raised in the writ petition has already been considered by this Court in a writ petition being Writ Petition (S/S) No. 683 of 2021, in which, while making reference to the judgments of the Hon'ble Apex Court, the same was thus disposed of, directing the respondents to consider and pass an appropriate order on the representation of the petitioners and that representation was directed to be decided by the respondents within the period of two months from the date of service of the certified copy of the judgment is presented before the competent authority.
The learned Additional C.S.C, Mrs. Anjali Bhargava, very candidly has admitted the fact that the issue stands covered by the judgment rendered in WPSS No. 683 of 2021 dated 23.06.2021 (which will form part of this judgment, for the purposes of deciding the representation).
Hence, this writ petition too would stand disposed of under the same terms and conditions of the judgment dated 23.06.2021, rendered in WPSS No. 683 of 2021.
However, the Registry of this Court, is directed to ensure that Court fee has been paid, before supplying the certified copy of this judgment to the counsel for the petitioner or anyone else.
