ON THE 23RD DAY OF JUNE, 2021
                         BEFORE:
HON'BLE SHRI JUSTICE MANOJ KUMAR TIWARI

    WRIT PETITION (M/S) No. 1669 of 2018

BETWEEN:

Guru Ram Dass (Post Graduate)
Institute of Management
and Technology. ....Petitioner

(There is no representation for the petitioner)

AND:
State of Uttarakhand
and another. ...Respondents
(By Mr. T.S. Phartiyal, Additional C.S.C. for the State of
Uttarakhand and Mr. Mukesh Kaparwan, Advocate for
     respondent no. 4)

                       JUDGMENT

This writ petition has been filed by Guru Ram Dass (Post Graduate) Institute of Management and Technology seeking the following reliefs:

"(i) writ order or direction in the nature of certiorari quashing the impugned order dated 18.5.2018 passed by registrar-cum-Secretary rejecting and returning the proposal of the petitioner for approval/permission to start of D.Pharm Course after making inspection by the respondent no.2 for the year 2018-19 or in subsequent session in the Institute of petitioner.

(ii) writ order or direction in the nature of mandamus directing the respondent to grant approval/permission to start of D.Pharm Course after making

inspection by the respondent no.2 for the year 2018-19 or in subsequent session in the Institute of petitioner."

2. Perusal of the writ petition indicates that petitioner had submitted proposal for permission to start D-Pharma Course for the academic session 2018-2019. His proposal was rejected by Pharmacy Council of India vide order dated 21.05.2018, which has been challenged in the present writ petition.

3. Since we are in the year 2021 and the reliefs, as claimed in the writ petition, cannot be granted after three years. In other words, the reliefs, as claimed in the writ petition, do not survive.

4. Accordingly, the writ petition is dismissed. However, dismissal of writ petition will not preclude the petitioner from applying afresh for permission to the concerned regulatory body.

(MANOJ KUMAR TIWARI, J.) Arpan
