Heard the matter through video conferencing.
Heard on the bail application. The appellant-Rohit Kumar has been convicted under sections 398, 401 IPC vide judgment and order dated 05.04.2021 passed by the learned Additional Sessions Judge, Khatima, District Udham Singh Nagar and has been sentenced accordingly.
It is submitted by the learned counsel for the appellant that the appellant was on bail during trial. He never misused the conditions as imposed by the trial court. Although, he is convicted under section 398 IPC but there is no independent witness of the recovery. Apart from that, there is no previous history. It will take time to hear the appeal on merit.
Accordingly, without going into the merit of the appeal, this Court thinks that it is a fit case for bail during the pendency of the appeal.
The bail application is allowed and the appellant is directed to be released on bail, during the pendency of the appeal, on his executing a personal bond and furnishing two reliable sureties in the like amount to the satisfaction of the court concerned.
List the matter on 25.08.2021 for final hearing.
Registry is directed to prepare the paper book and will supply the same to the learned counsel for the parties as per rule.
