Mr. Narendra Bali, learned counsel for the revisionist.

Mr. Deepak Bisht, learned B.H. for the State. Mr. Nikhil Singhal, learned counsel for the private respondent nos.2&3.

This criminal revision, preferred by the revisionist u/s 397 read with Section 401 of Code of Criminal Procedure, 1973 (hereinafter to be referred as Cr.P.C.), is directed against the judgment and order dated 01.03.2021 passed by learned Judge Family Court, Haridwar in Misc. Case No.249 of 2021, "Smt. Ruchi & Another vs. Praveen Kumar Tiwari", whereby the learned Judge allowed the interim maintenance application and the revisionist was directed to pay Rs.8,000/- per month to the respondents as an interim maintenance.

Both the learned counsel for the revisionist and learned counsel for the respondent nos.2 and 3 are mutually agreed to decide the maintenance application with the direction that the revisionist will pay Rs.6,000/- per month instead of Rs.8,000/- per month to the respondent nos.2&3 from 30.08.2019 till the decision of the main application filed under Section 125 Cr.P.C.

Accordingly, the present revision is disposed of finally with the following directions:-

1. The revisionist-Praveen Kumar Tiwari will pay Rs.6,000/- per month as an interim maintenance instead of Rs.8,000/- per month as awarded by the Judge Family Court from 30.08.2019.

2. The learned Judge Family Court is also directed to decide the application filed under Section 125 Cr.P.C., as early as possible preferably within a period of nine months from today.

3. The revisionist will pay the arrears of interim maintenance as modified by this Court to the respondents in four equal instalments within a period of six months.

4. The above observations made in this revision will not affect to the final merit of the case filed under Section 125 Cr.P.C. Pending application, if any, stands disposed of.
