This writ petition had been wrongly connected with the bunch of writ petitions which are listed today at Item No. 30. Hence, it is being disconnected and considered independently on the Time Extension Application, which has been preferred by the respondent/Nagar Palika.

In this case, the coordinate Bench of this Court, vide its judgment dated 26.03.2021, had disposed of this writ petition directing that all admissible dues payable to the petitioner, who is a retired employee and who has attained 71 years of age as of now, would be remitted by respondent No. 4. But, due to its non- compliance on account of the financial crises, the Time Extension Application has been preferred by respondent No. 4.

Without expressing any opinion on the merits of the matter and with regard to the propriety of the stand taken by the Nagar Palika of the financial constraints, which can never be a reason for non-compliance of the judgment, which had been passed by the High Court. But, still, in the wider interest of justice, since there is an undertaking given by the learned counsel for the respondent No. 4, that they would be positively remitting the admissible amount to the petitioner, as directed by the judgment passed by the coordinate Bench of this Court, within a period of one month, the Time Extension Application is accordingly disposed of and one month's time, by way of a last opportunity is provided to respondent No. 4, to comply the judgment dated 26.03.2021 and make the necessary payments to the petitioner.
