Judgement Date : 23 July, 2021
IN THE HIGH COURT OF UTTARAKHAND
AT NAINITAL
ON THE 23rd DAY OF JULY, 2021
BEFORE:
HON'BLE SHRI JUSTICE MANOJ KUMAR TIWARI
Writ Petition (M/S) No.1393 of 2021
BETWEEN:
Amita Sharma .....Petitioner
(Mr. Rajveer Singh, Advocate)
AND:
State of Uttarakhand & Others .....Respondents
(Mr. Rakesh Kunwar, Addl. C.S.C. along with Mr. Pradeep Hairiya,
Standing Counsel for the State)
JUDGMENT
Heard learned counsel for the parties through video conferencing.
2. By means of this writ petition, petitioner has sought the following reliefs:-
(i) Issue a writ, order or direction in the nature of mandamus directing the respondent nos.1, 2 and 3 to transfer the respondent no.4 to 10 from District Haridwar to another District as per law.
(ii) Issue a writ, order or direction in the nature of mandamus directing the respondent nos.1, 2 and 3 to decide representation dated 05.05.2020 of the petitioner.
3. The relief sought in the writ petition is that as many as seven officers of Consolidation Department be transferred from District Haridwar to some other district. It is not the case of the petitioner that she is herself an employee of Consolidation Department; what she says is that continuance of private respondents is against the transfer policy of the State Government. In the humble opinion of this Court, such relief cannot be granted at the behest of the petitioner.
4. Accordingly, writ petition fails and is dismissed. No order as to costs.
5. Pending application, if any, stands disposed of accordingly.
(MANOJ KUMAR TIWARI, J.) Rajni
