                                      Hon'ble Sharad Kumar Sharma, J.

(Via Video Conferencing)

Mr. Narendra Bali, Advocate for the petitioner.

Mr. I.P. Kohli, Standing Counsel for the State of Uttarakhand.

The petitioner contends that as against the preponment of the appellate proceedings by the court of Settlement Officer, Consolidation and the decision rendered thereto in the appeal, he has preferred a revision being Revision No.04 of 2021, Rahul vs. Gram Sabha and others; where a challenge has been given to the order of 29.07.2020. He has submitted that during the pendency of this revision, the respondents are proceedings to change and alter the nature of the property, which is subject matter of dispute.

Looking to the relief clause, as sought for in the present writ petition, this Court is not expressing any opinion on the merits of the matter. However, the writ petition is disposed of with a request to the Deputy Director, Consolidation, to decide the Revision No.04 of 2020-21, Rahul vs. Gram Sabha Gram Bhogpur & others as expeditiously as possible, but not later than four months from the date of production of the certified copy of this judgment. However, it is made clear that in case, if the petitioner has filed any interim application in the revision itself, that too would be considered by the revisional court and an appropriate order would be passed on the same.

However, the above direction is clarified that the stay application, if any, already filed would be decided within a period of one month and the revision itself within a period of four months.

Subject to the above observations, the writ petition stands disposed of.
