Since being a contempt petition, it cannot be dismissed for want of prosecution, hence it is being proceeded to be decided on its own merits, since it's a proceedings between the Court and the alleged contemnor.

The petitioner in the contempt has alleged the non compliance of the judgment rendered on 16.06.2015, by the coordinate Bench of this Court in Writ Petition (S/S) No. 534 of 2015, Smt. Chandra Prabha Devi Vs. State.

The coordinate Bench of this Court, vide its judgment dated 16.06.2015, had issued direction to the Principal Secretary (Health), Uttarakhand Government, to take decision on the representation of the petitioner.

The present contempt petition was filed on 05.05.2017, on which the notice was issued to the respondent on 11.05.2017, and ever since the present contempt petition was never listed thereafter.

The respondent have filed a compliance affidavit and in the compliance affidavit thus filed on 16.06.2017, the respondent has annexed an office memo dated 19.09.2016, whereby the decision on the representation of the petitioner as directed by the aforesaid judgment, has already been taken by an order No. 843/XXVIII-4-2016-26(fjV)/2016 dated 19.09.2016.

In view of the aforesaid, the order has been complied with. Consequently, the present contempt petition is closed. The notice issued to the respondent is hereby discharged.
