The petitioner has alleged that the judgment dated 28.09.2020, rendered in Writ Petition (S/S) No. 2159 of 2018, which was based on an earlier judgment, rendered by the coordinate Bench of this Court dated 29.07.2019, the direction was issued to the respondent to re-fix the pensionary benefits of the petitioner, after counting his services, rendered by him on ad-hoc basis. The petitioner alleges non- compliance of the same.
At this stage, re-fixation of the pensionary benefits and its recommendation has to flow from his appointing authority, who is respondent No. 4, herein in the present contempt petition.
Hence, at present, this Court is only issuing notice to respondent No. 4, to show cause as to why the proceedings under the Contempt of Courts Act may not be drawn against him for non-compliance of the aforesaid judgment.
The petitioner would take steps within a period of ten days from today.
Response may be filed by the respondent within a period of three weeks thereafter.
