2021 Latest Caselaw 141 UK

Citation : 2021 Latest Caselaw 141 UK
Judgement Date : 12 January, 2021

Uttarakhand High Court
CLCON/18/2021 on 12 January, 2021
CLCON No. 18 of 2021
Hon'ble Sharad Kumar Sharma, J.

Mr. Tarun Prakash Takuli, Advocate for the applicant/petitioner.

Mr. T.S. Fartiyal, Additional C.S.C. for the State of Uttarakhand.

The petitioner is a war widow and she is craving for the remittance of the amount payable to her as an ex-gratia in terms of the Government Order dated 05.03.2014, which has been made payable to the dependants or the widow of the martyrs. It is not in controversy that the late husband of the petitioner Mr. Praveen Singh Koranga, had died in an Army Operation, in order to retaliate a counter insurgency operation at district Rajouri in Jammu and Kashmir, on 17.04.2002; now we are in 2021 and the widow petitioner, despite of the judgment of 04.11.2020 passed by this Court is still craving for being remitted with the said amount.

The State takes a notice of the present contempt petition. The Secretary respondent no. 1, is directed to appear in person 14.01.2021 for taking an appropriate action for the sadistic attitude for war widows even or in an alternative to pay the amount, which the petitioner is entitled under the judgment by this Court, as well as in terms of the Government Order dated 05.03.2014.

Put up this contempt petition on 14.01.2021 as first case.

(Sharad Kumar Sharma, J.) 12.01.2021 Pooja
