Citation : 2021 Latest Caselaw 546 UK
Judgement Date : 26 February, 2021

Uttarakhand High Court
Kailash Mani vs State Of Uttarakhand And Others on 26 February, 2021
IN THE HIGH COURT OF UTTARAKHAND AT NAINITAL
                      Writ Petition (S/S) No. 144 of 2021

Kailash Mani ......... Petitioner

                                        Vs.
State of Uttarakhand and others .......Respondents

Present: Mr. Dinesh Gahtori , Advocate for the petitioner.
Mr. Narain Dutt, Brief Holder for the State/respondent nos. 1 and 2.

                                  JUDGMENT

Hon'ble Ravindra Maithani, J. (Oral)

Instant writ petition has been filed by the petitioner seeking directions that the process for recruitment to the post of Lecturer in Sociology in Inter College Devikhal (Bhanyasu), District Pauri Garhwal (for short "the College), as initiated by an advertisement dated 05.02.2016 be concluded as expeditiously as possible. Related reliefs have also been sought in the writ petition.

2. Heard learned counsel for the petitioner and learned State counsel and perused the record.

3. This is really a strange case. According to the writ petition, the respondent no.3 advertised the posts of Lecturer in Sociology in the College on 05.02.2016, but for one or the another reason, the process could not move further and the date for interview has yet not been fixed. In fact, directions have also been sought that respondent no.2 may be directed to consider and decided the representation dated 23.12.2020 submitted by the petitioner whereby it was requested that the process for interview may be concluded.

4. The matter was listed on 15.01.2021 when on behalf of the State time was sought for seeking instructions to explain as to why the process is so delayed.

5. Today, learned counsel for the State would submit that the process has moved ahead now and the date for interview has already been fixed for 05.03.2021. Learned State counsel would submit that this statement is given on the basis of instructions received from the Chief Education Officer, Pauri Garhwal.

7. The statements made by learned counsel for the State is placed on record.

8. In view of the statements, nothing survives and the writ petition stands disposed of.

(Ravindra Maithani, J.) 26.02.2021 Jitendra
