This civil revision has been filed under Section 115 of the Code of Civil Procedure, 1908 against the order dated 11.11.2021, passed by the Ist Additional Civil Judge (Sr.Div.), Dehradun in Original Suit No.505 of 2016, "Veena Devi vs. Mussoorie Dehradun Development Authority and Another", whereby the application, filed by the revisionist/defendant no.2, under Order 7 Rule 11 of CPC, has been rejected.

Heard Mr. Siddhartha Singh, the learned counsel for the revisionist and Mr. Rahul Consul, the learned counsel for the respondent no.2.

The learned counsel for the revisionist and the learned counsel for the respondent no.2 have relied upon a judgment dated 19.06.2018, passed by the Division Bench of this High Court in WP(PIL) No.119 of 2013, "Anuj Consel vs. State of Uttarakhand and Others".

The revision is admitted.

Issue notice to the respondent no.1. Steps to be taken within a week. List this case on 23.02.2022. Meanwhile, in case, an application for adjournment is moved by the revisionist-Sita Kumari before the learned trial court, the learned trial court shall consider the same till 23.02.2022 only.
