Mr. M.C. Pant and Mr. Sanjay Kumar, the
learned counsel for the appellants would argue that in
view of the judgment passed by this Court in the case
of "Kundan Singh vs. State of Uttarakhand & others",
Writ Petition (PIL) No.116 of 2018, dated 12.11.2018,
the appellants are entitled to benefits.
However, it is brought to our notice that in the
meanwhile, the State of Uttarakhand has preferred the
SLP No.2388 of 2019, before the Hon'ble Supreme
Court.
It is, therefore, expedient on our part to avoid
the judgment and to wait for the final decision of the
Hon'ble Supreme Court in the matter.
