This Criminal Revision is preferred against the judgment and order dated 12.07.2017 passed by Civil Judge Junior Division 1st, Nainital in Criminal Case No.413 of 2016 "Sanjay Kumar vs. Kailash Arya" as well as order dated 07.10.2021, passed by 2nd Additional Sessions Judge, Nainital, in Criminal Appeal No.106 of 2017 "Kailash Arya vs. State of Uttarakhand".

Heard on Bail Application (IA/1/2021). It is submitted by learned counsel for the revisionist that the revisionist was on bail during the trial as also appeal; he did not misuse the conditions of bail as imposed upon him by the Lower Court; he is ready to furnish the sureties and he may be granted bail.

In the given facts, the revisionist is entitled for bail at this stage Accordingly, the revisionist is directed to be enlarged on bail on his executing a personal bond and furnishing two sureties each in the like amount, to the satisfaction of the Court concerned, subject to the condition that he will deposit Rs.1,00,000/- before the concerned Lower Court. Deposit of fine shall be a condition precedent for his release.

Bail application is disposed of in the above terms.
