The petitioner, who was initially inducted with the respondents as a driver in May 1987 and after having rendered his satisfactory services, he had attained the age of superannuation on 30.04.2017.

The grievance of the petitioner, is that despite the sanction having been granted for the remittance of leave encashment amount to the tune of Rs. 3,87,082/-, the same has not yet been remitted to him and the fact of the aforesaid sanction has been received by the petitioner through an information, which has been supplied to him under the Right to Information Act, whereby the communication has been made by the Information Officer on 14.10.2019.

Apart from it, the learned counsel for the petitioner submits that the issue with regard to remittance of leave encashment amount would stand covered by one of the judgments rendered by this Court in Writ Petition (S/S) No. 657 of 2021, Omveer Singh Vs. State of Uttarakhand, as decided on 16.06.2021.

Hence, this writ petition too would stand disposed of under the same terms of the judgment dated 16.06.2021, so far it relates to its clause (ii) for the purposes of remittance of leave encashment amount within the period as provided therein in the judgment dated 16.06.2021.

Subject to above observations, the writ petition would stand disposed of.

Respondents would ensure the remittance of leave encashment, as claimed by the petitioner within the period of two months from the date of service of the certified copy of this judgment.
