                       JUDGMENT

1. This contempt petition has been filed alleging non-compliance of order dated 06.04.2017 passed by Writ Court in WPSS No. 1436 of 2016. By the said order, respondents were directed to consider petitioner's case for appointment also at par with others who were appointed.

2. Learned Standing Counsel for the opposite party has produced in Court an order passed by Division Bench in SPA No. 473 of 2017. Learned Standing Counsel has further apprised the Court that against the order passed by Writ Court, State has filed said Special Appeal and learned counsel for the petitioner had made a statement that he will not press the contempt petition till the next date of listing. The order produced in Court is taken on record.

3. Since petitioner had given an undertaking before the Division Bench of this Court that he will

not press the contempt petition till next date of listing and the said undertaking has not been withdrawn, therefore, the contempt petition is closed at this stage with liberty to the petitioner to file fresh contempt petition, in case appeal is decided in his favour. Notice issued to the opposite party is hereby discharged.
