Ms. Seema Sah, learned counsel for the revisionists.
Ms. Manisha Rana Singh, learned A.G.A. along with Ms. Sonika Khulbe, learned B.H. for the State.
Heard.
This revision is directed against the judgment and order dated 12.12.2019 passed by learned First J.M. Roorkee in Crl. Case No.3134 of 2014, State v. Shamim and others as well as the judgment and order dated 04.08.2021 passed by the Second Additional Sessions Judge, Roorkee (Haridwar) in Crl. Appeal No.313 of 2019, Rafi and another v. State and Crl. Appeal No.10 of 2020, Rajab Ali v. State.
Admit.
Summon the LCR.
List thereafter.
Also heard on the bail application (IA 1/21). The revisionists were on bail during trial; they did not misuse the condition as laid down by the trial court; looking to the facts and circumstances, the present revisionists deserve bail at this stage.
The bail application is thus, allowed. All the three revisionists are enlarged on bail on each of their executing personal bond(s) and furnishing two-two sureties, each of the like amount, to the satisfaction of the court concerned.
However, realisation of fine is not stayed and the revisionist shall deposit the fine as imposed against him.
