(Via video conferencing).

Mr. Ramji Srivastava, Advocate, for the applicant.

Mr. V.K. Jemini, Deputy Advocate General with Ms. Meena Bisht, Brief Holder, for the State of Uttarakhand.

Initially considering the fact that the applicant, who is a senior citizen of 71 years of age, who is shown to be an accused in Case Crime No.143 of 2020, was granted a short term bail for a period of two months vide judgment and order dated 14.06.2021; because the applicant was detected as Covid-19 positive.

Today, the matter is listed on the time extension application, which has been preferred by the applicant, on the ground that the applicant has been diagnosed as suffering from COPD and bleeding in the rectum, for which according to the opinion expressed by the Synergy Hospital, Dehradun, Deen Dayal Hospital, New Delhi, the applicant has been advised to undergo a surgery.

As per the averments made in the time extension application, the learned counsel for the applicant argues that in all probability, the surgery may be conducted upon the applicant within a period of one month from today. Hence, for a period of six weeks, the short term bail, which was already granted by this Court, on 14.06.2021, would remain extended. However, with a rider that immediately after recovering from the surgery, which is expected to be taken on him, he would surrender before the jail authorities after the expiry of the aforesaid period.

Subject to the above, time extension application stands disposed of. The short term bail granted by this Court on 14.06.2021, would remain extended for six weeks from today.
