As a result of the accident, which has chanced on 13.08.2017, the husband of the respondent No.1, Late Mr. Jaswant Singh, has met with the sad demise. On the culmination of the proceeding of MACP Case No.288 of 2017, which was rendered by an award dated 22.01.2021, the total amount of compensation, which has been determined to be paid was on the basis of the salary drawn by the deceased/Jaswant Singh, who was of 53 years of age, at that relevant point of time, working as an Assistant Teacher. The compensation was assessed to be made payable to the tune of Rs.68,07,005/-.

This Court while admitting the appeal from order on 09.04.2021, had directed the appellant to deposit the entire amount, before the MACT concerned, and the same has been deposited in compliance thereto, along with an interest.

Today the matter is listed on the money withdrawal application.

Considering the fact that the widow and

herein, in order to sustain themselves in life after the death of the only breadwinner, it would be in the interest of justice that 25% of the total awarded amount i.e. Rs.68,07,005/-, is permitted to be withdrawn by the respondent No.1, herein.

Accordingly, the money withdrawal application would stand disposed of with a direction to the MACT Tribunal/Additional District Judge, Khatima, District Udham Singh Nagar, before whom the money stands deposited, to remit the 25% of the awarded amount to the respondent No.1 to 3, herein, within a period of six weeks from the date of the presentation of the certified copy of this judgment.

Accordingly, the money withdrawal application stands disposed of.

List this appeal from order in the last week of September, 2021.
