Vide impugned judgment and order dated 5.4.2021, the appellant-applicant has been convicted for the offence under Section 8(c)/20(b)(II)(B) of the NDPS Act and sentenced to undergo R.I. for four years and to pay a fine of rupees ten thousand.
Learned Counsel for the appellant submitted that the appellant was on bail during trial and he never misused the liberty; that the maximum sentence imposed on the appellant is of four years; and the appellant is in jail since 5.4.2021.
Learned State Counsel submitted that the appellant stood convicted after trial.
Having heard learned Counsel for the parties and considering the facts and circumstances of the case, and without any comment on the final merits of the appeal, the Court is of the opinion that the appellant deserves bail at this stage.
Consequently, bail application (IA 1/2021) is allowed.
Let the appellant be released on bail on the same terms and conditions on which he was granted bail during trial. Appellant shall also deposit the amount of fine before his release from the jail.
