After arguing for some time, learned counsel for the petitioner wants to address the Court as to what would be the impact of the judgment of 04.08.2020, by virtue of which, her writ petition, preferred earlier, being WPMS No.683 of 2020, "M/s Aryan Construction & Associates Vs. State of Uttarakhand", was "dismissed as withdrawn" and "liberty was sought by the petitioner to file the representation". The issue would be as to whether the representation thus permitted to be filed, at the request of the petitioner would fall to be a representation which is a forum available to her under the law?
The second question, which is to be answered by the petitioner, is that, where a petitioner has put a challenge to a notification dated 19.06.2017, in the earlier writ petition, and while deciding the writ petition by the judgment of 04.08.2020, the petitioner has not pressed the writ petition on merits. Whether that would attach finality to the notification of 19.06.2017? Under the principle that a relief claimed, if it is not granted would stands denied.
Put up this writ petition on 06.08.2021, in order to enable the learned counsel for the petitioner to argue the aforesaid two aspects.
