The supplementary counter affidavit filed by respondent No.2, along with IA No. 2 of 2021, is allowed.

The supplementary counter affidavit is taken on record.

The learned counsel for the petitioner makes a statement at the Bar, that he does not propose to file any supplementary rejoinder to the said affidavit.

Besides this, the learned counsel for the petitioner, also argues that the issue involved in the present Writ Petition stands covered by the judgment rendered by the Coordinate Bench of this Court in Writ Petition (M/S) No. 1845 of 2009, as decided by the judgment of 9th April, 2015, which has attained finality upto the Hon'ble Apex Court.

In order to answer the said fact, the learned Addl. C.S.C, prays for that the matter may be posted next week.

The prayer is accepted.
