The petitioners have preferred the present writ petition, challenging the judgment dated 28.01.2021, which has been passed by the Debts Recovery Tribunal, Dehradun in O.A. No.333 of 2020, "Central Bank of India Vs. Vijendra Singh & others", whereby in a proceeding drawn under Section 19 of the Recovery of Debts and Bankruptcy Act, 1993, has been decided against the petitioners, directing to recover the amount, as mentioned therein.
As against the said judgment, there are two statutory remedies, which are available to the petitioners. On this, while addressing the writ petition on merits, the learned counsel for the petitioners submits that the writ petition may be dismissed as withdrawn, reserving his liberty to prefer a review application, as it has been contemplated under Rule 5A of the DRT (Procedural Rules 1993) and the issue of limitation would be construed liberally, if review is filed within four weeks from date of receipt of this judgment.
According, the writ petition is dismissed as withdrawn, subject to the aforesaid liberty.
