CRLR No.109 of 2021
Hon'ble R.C. Khulbe, J.
Mr. Tapan Singh, learned counsel for the revisionist.
Mrs. Pushpa Joshi, learned Dy. A.G. with Mr. Siddartha Bisht, learned B.H. for the State.
Heard.
This revision is directed against the judgment and order dated 11.11.2016 passed by learned Chief Judicial Magistrate, Haridwar, in criminal case no.721 of 2009, 'State vs. Firoj & another as well as order dated 12.01.2021 passed by learned 5th Addl. Sessions Judge, Haridwar, in criminal appeal no.179 of 2016, 'Firoj and another vs. State'.
Admit.
Summon the LCR.
List thereafter.
Also heard on the application for bail (IA1/21).
It is argued that the revisionist was on bail during trial and he never misused the conditions as imposed by the Trial Court as well as Appellate Court.
The State counsel has no serious objection to the same.
Looking to the facts and circumstances of the case, the revisionist is enlarged on bail on his executing personal bond and furnishing two sureties, each in the like amount, to the satisfaction of the Court concerned.
The revisionist, however, shall deposit the fine as imposed by the Trial Court against him.
Bail application is allowed accordingly.
