Heard learned counsel Mr. A Bhoumik, appearing on behalf of
the applicants as well as Mr. Pradyumna Gautam, learned Sr. GA appearing
on behalf of the State- respondents.
2. At this stage, the learned Sr. GA Mr. Gautam, drawn the
attention to allow the petitioners to file objection against the interlocutory
application filed by the applicants. To this, learned counsel Mr. Bhowmik,
submitted that the last date for filing application is 26.02.2026 and if no
order is passed today then the very purpose of filing the IA would be
frustrated and it was further submitted by learned counsel Mr. Bhoumik, that
the copy of the IA had already been furnished to learned Sr. GA Mr.
Gautam, at the time of filing of the same.
3. Accordingly the matter is taken up for hearing.
4. At the time of hearing, learned counsel Mr. Bhaumik, drawn the
attention of the Court that the present petitioners have filed the writ petition
before this court for directing the respondents to issue their TET certificates
as they could qualify the written examination conducted by TRBT but at the
time to scrutiny of documents, the TRBT informed that the TET certificates
cannot be issued in their favour on the ground that they have conducted
D.El.Ed. from NIOS with a duration of 18(eighteen) months and the
D.El.Ed. programme was not concluded within 31.03.2019.
5. It was further submitted by learned counsel Mr. Bhaumik that
in spite of specific direction of the Hon'ble Supreme Court the respondent-
TRBT is not declaring the TET results of the present petitioners and for such
compelling circumstances they have filed the writ petition which is pending
for adjudication and by this time TRBT has issued notification on
21.02.2026 for selection to the post of Under Graduate Teachers and
Graduate Teachers for Elementary Education Directorate, Education
(School) Department of Government of Tripura and if at this stage they are
not allowed to apply against the said advertisement for the post of Graduate
Teachers and Under Graduate Teachers without the TET certificate, then the
very purpose of the IA would be frustrated and also the present petitioners
would be deprived from applying for the said posts for which notification
has been issued by TRBT.
6. Learned Sr. GA Mr. Gautam, submitted that the case is still
pending for adjudication and as such, it would be unwise to issue any
appropriate direction.
7. Heard both the sides.
8. It is the admitted position that the Hon'ble Supreme Court of
India vide judgment and order dated 10.12.2024 in Viswanath & Ors. Vs.
State of UttaraKhand (2025) 6 SCC 808 and in Koushik Das & Ors. Vs.
State of West Bengal (2025) 5 SCC 413 accredited 18 (eighteen) months
D.El.Ed. course as an one time window through NIOS. The present
petitioners have undergone the said D.El.Ed. course through NIOS.
9. However, the writ petition is pending for adjudication. So
considering the present facts and circumstances, it is ordered that the
respondent authority shall allow the present petitioners to apply for the
required posts against the Notification dated 21.02.2026 (Annexure-1)
issued vide No.F.2(1-18)GEN/TRBT/REC/2024/108 by TRBT in absence of
TET certificates which would be subject to outcome of the writ petition,
filed by the petitioners.
10. With this observation, the present IA is disposed of.
Supply a copy of this order to learned counsel Mr. Bhoumik,
for the petitioners. A copy of this order be also supplied to learned Sr. GA
Mr. Gautam, for information and necessary action.
