This application has been filed seeking permission of the Court
for depositing half of the decretal amount as directed in the interim order dt.
24.11.2025 in IA No. 02 of 2025 in Commercial Appeal No. 01 of 2025,
which as per the said order, was directed to be deposited in the account of
the Judge, District Commercial Court, Unakoti, Kailashahar, in T.S
(Commercial) 01 of 2020.
It is brought to our notice by counsel on both sides that the
compliance could not happen for the reason that there was no designated
head of account available in the said Court to deposit the said amount.
In view of the said submission, the order dt. 24.11.2025 in IA
No. 02 of 2025 in Commercial Appeal 01 of 2025 and IA No. 02 of 2025 in
Commercial Appeal 02 of 2025 is modified, permitting deposit by the
appellants of the 50% of the decretal amount directed in the order dt.
24.11.2025 in the name of the Registrar General of this Court in place of the
Judge, District Commercial Court, Unakoti, Kailashahar.
Such compliance shall be made within 8 weeks from today
without fail.
Both the interlocutory applications are disposed of.
