Learned Counsel, Mr. A. Bhaumik is present for the

petitioner.

It is the case of the petitioner that this present petitioner

and others were appointed as Auditors and in the seniority list

dated 03.09.2008 (Anenxure-10), this present petitioner and the

name of other candidates were reflected. As per seniority list the

name of the petitioner was in serial No.32 and one Sanjit Das was

in Serial No.31. Another Uttam Kr. Das was in Serial No.33 and

Debashish Naha was in Serial No.47. But when the list of the

promotion came out that time it was found that excepting the

petitioner those persons who were junior to him were promoted

and even in respect of Sanjit Das a supernumerary post was

created in Serial No.31 which shows arbitrariness on the part of

the respondent authority and for that the petitioner has compelled

to file this writ petition.

Learned Sr. G.A., Mr. P. Gautam appears and accepts notice

on behalf of all the respondents and thus, formal notice upon

those said respondents is thus waived.

The respondents are asked to file their counter-affidavit, if

any supplying copy to the other side on the next date.

List the matter on 02.07.2026.
