When the matter is called, Mr. K. Datta, learned counsel, appears for the appellant. Mr. P. Gautam, learned Senior G.A., Mr. Kohinoor N. Bhattacharyya, learned G.A., Mr. Sankar Lodh, learned counsel, and Mrs. P. Chakraborty, learned counsel, appear for the respective respondents.

It is seen from the office note that, so far as respondent No. 2 is concerned, proof of service has not been received by the Registry.

However, this Court once again directs the learned counsel appearing for the appellant to take out notice upon respondent No. 2 at the address shown in the cause title in the United States of America (USA), by way of Registered Post with Acknowledgment Due (RPAD) through India Post, or through a recognized courier service, or through e-mail, and to file proof of service along with proof of delivery/receipt of the notice.
