Heard learned counsel Ms. I Chakma, appearing for the

petitioner.

Learned counsel submits that the petitioners were

engaged as casual workers under the respondents on 01.07.2010

and 16.11.2010 respectively, and they have been performing the

duties and responsibilities of the post of Cleaner (Group-D) with

utmost sincerity and dedication and they have already completed

ten years of their service, but despite that, minimum pay scale

meant for the post of Cleaner (Group-D) is not provided to them

and therefore, this writ petition has been filed.

Learned counsel also submits that earlier the petitioner

Sri. Biswa Biswas filed a writ petition bearing No. WP(C)

No.217/2021 praying for his regularization in service and similar

writ petition was also filed by the petitioner No.2. However, said

WP(C) No.217/2021 was rejected vide order dated 24.11.2022

with liberty to the petitioner to submit representation to the

appropriate authority and respondents were directed to dispose of

the said representation, if so filed, in accordance with law.

Thereafter, challenging the said order, petitioner No.1

herein, Sri. Biswa Biswas filed WA No.15/2023 and the Division

Bench disposed of the matter on 17.04.2024 affirming the

judgment of learned Single judge. However, it was observed by

the division bench that if the respondents were taking work from

the petitioner in the post of Cleaner for more than ten years, by

now they should consider the representation of the petitioner for

grant of minimum scale of pay for such equivalent post in the

establishment, in accordance with law, preferably within twelve

weeks from the said order.

As submitted by learned counsel, petitioner No.2

herein, Premjit Singha also submitted a similar writ appeal which

was also disposed of by the above said common order. Thereafter,

the State preferred two civil Special Leave Petitions before the

Hon'ble Supreme Court against the said order, but ultimately the

same was withdrawn. Thereafter, in terms of the direction given

by the Division Bench, the state respondents have issued order

dated 11.02.2025 by disposing of the said representation of the

petitioners without giving any relief to them and therefore, the

present writ petition has been filed.

Learned GA has appeared for all the respondents and

waived service of notice upon them. Learned GA also submits that

learned Addl. GA, Mr. K De will be representing the state

respondents in this case.

Learned GA has prayed for time to submit the counter

affidavit.
