When the case is called, there is no representation from the

appellant.

Mr. S. Datta, learned counsel appearing for the respondents

submits before this court that the appeal is not maintainable as the appellant

herein is only a noticee and the matter is covered by number of judgments

passed by this Hon'ble Court. He, therefore, prays to follow the same and

dismiss the present appeal.
