By the impugned judgment dated 22.04.2025 passed by the

Court of Additional Sessions Judge, Khowai District, Tripura in Criminal

Appeal No.09/2024, the judgment of conviction and order of sentence dated

29.11.2024 passed by the Chief Judicial Magistrate, Khowai, Tripura in

PRC (WP) No.31/2021 whereby the petitioners were convicted under

Section 332/34 of IPC and sentenced to undergo simple imprisonment for

two years along with fine of Rs.10,000/- each and further convicted under

Section 3 of the Tripura Medicare Service Persons and Medicare Service

Institutions (Prevention of Violence & Damage to Property) Act, 2013 and

sentenced to undergo simple imprisonment for one year with a fine of

Rs.5,000/- has been upheld. Petitioners have, therefore, preferred this

revision petition under Sections 397 read with Section 401 of the Cr.P.C.

Mr. Debalay Bhattacharya, learned senior counsel for the

petitioner also prays for stay of the operation of the sentence of the learned

Trial Court as petitioners are all along on bail during trial.

Call for the Lower Court Records.

Registry to prepare the Paper Book on receipt of LCRs.

List the matter for hearing in usual course.

In the meantime, subject to deposit of the fine amount by the

petitioners before the learned trial court within a period of two weeks from

today, the impugned order of sentence dated 29.11.2024 passed by the

learned CJM, Khowai in PRC(WP) No. 31 of 2021 as affirmed in appeal by

judgment dated 22.04.2025 passed by the Additional Sessions Judge,

Khowai District, Tripura in Criminal Appeal No.09/2024 shall remain

stayed.
