HON'BLE MR. JUSTICE ARINDAM LODH Order 28/02/2025 Heard Mr. B.N. Majumder, learned senior counsel assisted by Mr. Elembrok Debbarma, learned counsel appearing for the petitioner. Also heard Mr. D. Sarma, learned Addl. GA appearing for the respondents-State and Mr. Raju Datta, learned counsel appearing for the respondents-TPSC.
The present writ petition has been filed by the petitioner challenging the advertisement dated 30.01.2025 issued by TPSC(Annexure-L to the writ petition).
The grievance of the petitioner is that he applied to the post of Assistant Professor in Bengali in response to some earlier advertisements and got selected, but that process was cancelled by a Division Bench of this Court vide judgment and order dated 26.02.2016 passed in WP(C) No.172 of 2015(Annexure-B to the writ petition). The Government policy dated 20.08.2018 lays down that any person who participated in any selection process prior to the date of issuance of the said policy would be given an opportunity to appear in any subsequent selection process after giving one- time relaxation. Even, such candidates need not apply afresh. The petitioner has tried his level best to appear in the selection process initiated on 30.01.2025, but in the meantime, he crossed the upper age limit. His further grievance is that in the impugned advertisement dated 30.01.2025, there is no such clause as mentioned in the policy dated 20.08.2018. In view of this,
the petitioner has sought for protection and he has tried to establish his right in view of the policy dated 20.08.2018.
Prima facie, I find merit in the present writ petition. The petitioner is to be allowed to appear in the examination.
However, Mr. Datta, learned counsel for the respondents-TPSC has submitted that he will examine the matter and will file a short affidavit in response to the grievances of the petitioner agitated in this writ petition.
Mr. Sarma, learned Addl. GA for the respondents-State has also adopted the submissions advanced by Mr. Datta, learned counsel for the respondents-TPSC.
At the request of Mr. Datta, learned counsel for the respondents-TPSC, list the matter on 05.03.2025 when an endeavour shall be taken to dispose of the matter finally.
