The applicant appellants filed the instant
Interlocutory Application(IA) under Section 5 of the
Limitation Act, 1963 for condoning the delay of 3 days in
preferring the connected second appeal [RSA No.17 of
2025] against the Judgment dated 29-03-2025 passed
by Ld. Addl. District Judge, Dhalai, Ambassa in case
No.Title Appeal 14 of 2023 and the consequent decree
drawn thereupon.
Registry has reported that notices upon respondent
Nos.9 to 11 are served but they have not appeared.
Heard Ld. Counsel Mr. D. Pal for the appellants and
Ld. Addl. GA, Mr. K. De, for respondent Nos.1 to 8.
There is only 3 days' delay in filing the second
appeal. Ld. Addl. GA, therefore, does not oppose the
prayer.
The period of delay is very minimum.
Court is satisfied.
The delay in preferring the appeal is condoned.
The IA is accordingly disposed of.
