Order 03/10/2024 Learned counsel Mr. B. Majumder is present for the

appellant-applicant.

Learned Senior Counsel Mr. T. D. Majumder assisted by Mr.

D. Kalai, Learned counsel is present for the respondents No.1, 2

and 3. None has appeared on behalf of the owner-respondent.

The applicant-appellant has preferred this appeal challenging

the judgment and award dated 24.08.2023 passed by Learned

Member, MACT, Tribunal No.2, West Tripura, Agartala in

connection with case No.T.S.(MAC) No.136 of 2018 and along with

the memo of appeal an application under Section 5 of Limitation

Act is filed for condoning delay of 188 (one hundred and eighty

eight) days.

Learned counsel for the appellant-applicant at this stage

urged for allowing this application for condonation of delay.

On the other hand, Learned Senior counsel appearing for the

claimant-respondents opposes the application for condonation of

delay and submitted that 188(one hundred and eighty eight) days

delay could not be explained properly by the appellant-applicant

and urged for dismissal of this application.

Seen the application for condonation of delay and also the

grounds as mentioned in the application.

Since the appellant-applicant is the insurance company so it

is quite natural that just after the judgment and award passed

they were to process the file and after obtaining approval from the

authority the appeal is preferred. So in my considered view the

grounds mentioned in the application are satisfactory.

Accordingly, the delay of 188(one hundred and eighty eight)

days are hereby condoned.

Thus, this IA stands disposed of.
