Heard Mr. S. Bhattacharjee, learned counsel for the applicant. Also
heard Ms. R. Chakraborty, learned counsel appearing for the respondents-
State.
This is an application filed under Section 5 of the Limitation Act, 1963
for condoning the delay of 46 days in preferring the writ appeal against the
judgment and order dated 08.02.2024 passed in WP(C) 427 of 2023.
Issue Notice calling upon the respondents to show cause as to the delay
of 46 days in preferring the writ appeal shall not be condoned, as prayed for;
and/or why such further and other order(s) shall not be passed as to this
Court may deem fit and proper.
Notice is made returnable on 27.06.2024.
Since Ms. R. Chakraborty, learned counsel appears and accepts notice on
behalf of respondents no. 1 2 and 3, no formal notice needs be issued upon
those respondents.
The applicant shall take steps for service of notice upon the remaining
respondents within 7 days by registered post with AD.
