HIGH COURT OF TRIPURA
AGARTALA
CRL.PETN. NO.5 OF 2024
Sri Chandan Debnath
Vs.
Smt. Suniti Nath and ors.
HON'BLE MR. JUSTICE T. AMARNATH GOUD
Present:
For the Petitioner(s) : Mr. R.G. Chakraborty, Advocate.
For the Respondent(s) : Mr. Raju Datta, P.P.
05.03.2024
Order
This present petition has been filed under Section
482 of Cr.P.C. for invoking inherent power of High Court and set
aside the judgment and order dated 01.09.2021 passed in
Criminal Revision No.01/2017 by the learned Sessions Judge,
Dhalai Tripura. The learned Sessions Judge dismissed the
revision petition and upheld the order dated 25.07.2017 passed
by the learned SDJM, Kamalpur, Unakoti Tripura in
C.R.(C)20/2013 and to direct learned SDJM Kamalpur to restore
Case No.Misc.73/2013.
Heard Mr. R.G. Chakraborty, learned counsel
appearing for the petitioner as well as Mr. Raju Datta, learned
P.P., appearing for the State-respondent.
It is seen from the record that on 2011 a complaint
was made indicating that the husband-complainant purchase a
motor vehicle at Rs.18,000/- and the wife-respondent had stolen
the same. The husband is pursing the litigation against his wife
on an allegation of theft case of that motor bike of Rs.18,000/-
from 2011 onwards till date moving all Courts and police
authorities seeking redressel of the same.
A fair reading of the impugned order does not draw the
attention of the Court seeking any interference. As such, this
present criminal petition is dismissed. As a sequel, stay if any
stands vacated. Pending application(s), if any stands closed.
