When the case is taken up both Ms. R. Dey, Learned

counsel representing the appellant and Mr. D. Bhattacharya, Learned

senior counsel for the respondent No.1 are present.

Mr. Bhattacharya, Learned senior counsel appearing for

respondent No.1 has submitted that this case is squarely covered by a

judgment of this Court passed by a Division Bench in RFA No.08 of 2022

dated 22.02.2024.

Ms. R. Dey, Learned counsel appearing for the appellant

seeks an accommodation for ascertaining the said fact whether the

present case is covered or not and take further instruction from her

senior.
