No.1. Let his name appear in the cause list. Respondent No.2 insurance

company has also been properly served but no one has entered

appearance for them till date.

This appeal arises out of the award dated 23.09.2022 against

which the insurance company i.e. United India Insurance Company

Limited has also preferred an appeal [MAC No.03 of 2023] which is

already admitted for hearing and on board today.

Upon hearing learned counsel for the applicant and the

respondent No.2 and on consideration of the explanation urged, delay of

146 days in preferring the appeal is condoned.

Application stands disposed of.

The instant appeal [Mac No.43 of 2023] is admitted.

Lower court records have already been received and Paper

Book has also been prepared in the connected appeal [Mac App No.03 of

2023]. Let Mac App No.43 of 2023 be tagged with Mac No.03 of 2023

and be listed under the heading hearing.

In the meantime, since the next National Lok Adalat is

scheduled to be held in the premises of this Court in September 2023,

therefore, the parties are advised to participate in the National Lok

Adalat. The Secretary, High Court Legal Services Committee shall

convene pre Lok Adalat conciliation meetings with the parties to see that

the dispute can be amicably settled. Parties are expected to cooperate.

Let the order be communicated to the Secretary, High Court

Legal Services Committee.

IA No.03 of 2023 seeking exemption from filing certified

copy of the judgment is disposed of since the lower court records have

already been received.
