Appellant-wife is aggrieved by the impugned judgment and
decree dated 28.01.2020 passed by the learned Judge, Family Court,
Sonamura, Sepahijala Judicial District whereby the suit No. T.S.(DIV) 23 of
2016 preferred by the respondent-husband for dissolution of marriage under
Section 13(1)(ia) & (ib) of the Hindu Marriage Act, 1955 has been allowed
on grounds of adultery and desertion. It appears that no effort for amicable
settlement of their matrimonial dispute has been made at the appellate stage.
When heard, learned counsel for the parties also agree that an effort for
amicable settlement of the matrimonial dispute can be made at this appellate
stage also in spirit of the Family Courts Act, 1984.
We, therefore, direct the parties to appear on the next date
(16.05.2023) so that an effort for amicable settlement of their dispute may be
made before adjudication on merits.
Let the case be listed on 16.05.2023.
Meanwhile, learned counsel for the parties may obtain the paper
books also.
